• A civil lawsuit is a legal procedure that deals with private or civil rights and obligations.

• A civil lawsuit is started when an unresolved dispute arises over the private rights or obligations of two or more parties.

• Civil Cases include different types of disagreements in areas ranging from personal injury to contract disputes.

What to Prove In Order to Win Your Civil Case:


1. You have to prove that the person you are suing had some obligation not to cause your injury or loss. This is also called “duty of care”. For example, if you are alleging your doctor owed you a duty of care, this could be proven by the fact of them being your doctor and you being their patient.

2. You have to prove that the person you are suing violated a measure of how they are supposed to behave as viewed by a reasonable person. This is also called “standard of care”. For example, when you are alleging your doctor failed the “standard of care”, you are saying that they did not act like a competent doctor.

3. You must prove that the person you are suing, with their failure to take proper care, actually caused you injury or loss.

4. You must prove that you actually suffered an injury or loss.
